Students that are issued a summons or are arrested for a violation of law are subject to prosecution under the criminal code.  In addition, the College may proceed with disciplinary action initiated by the Student Court. Members of the Hampden-Sydney College Police Department are certified by the Commonwealth of Virginia as police officers and are responsible to uphold the laws of Virginia. Therefore, students suspected of violating the law ordinarily are referred to the Office of the Commonwealth's Attorney which then determines whether to proceed with criminal prosecution.
